Contributor’s Agreement

These terms and conditions (the “Terms”) set out the basis on which you (“the Contributor”) submit any Contribution to It’s a Jungle Pty Ltd (“It’s a Jungle”).

The Contribution

1. In these Terms, “Contribution” refers to any contribution submitted by the Contributor to It’s a Jungle in which Copyright can subsist, including but not limited to a literary work; “Copyright” means all copyright and rights in the nature of copyright subsisting in the Contribution in any part of the world to which the Contributor is, or may become, entitled; and “Website” means the website operated by It’s a Jungle at the URL <https://itsajungle.com/>.

2. The Contributor retains Copyright ownership of the Contribution.

3. The Contributor hereby grants to It’s a Jungle an irrevocable, perpetual, royalty-free licence (the “Licence”) to use any Contribution submitted by Contributor to the Website pursuant to these Terms.

4. Contributor acknowledges that It’s a Jungle, as the licensee of the Contribution, is permitted to use the Contribution in any way. For the sake of clarity, this includes but is not limited to rewording, retouching, editing or otherwise altering or modifying the Contribution, whether:

  • i. in whole or in part; or,
  • ii. alone or in combination with any other materials.

Contributor acknowledges that any alterations will be for formatting and abbreviation reasons and that It’s a Jungle will make efforts not alter the intended meaning of the Contribution.

5. Unless otherwise agreed by a director of It’s a Jungle in writing, the Licence includes, but is not limited to:
• publication of the Contribution on the Website and/or other internet sites;
• distribution of the Contribution in print, digital, audio visual or in any other format or media;
• storage of the Contribution in print, digital, audio visual or in any other format or media; and
• inclusion of the Contribution in online databases, news services and search archives.

6. The Contributor acknowledges It’s a Jungle at its discretion may or may not publish any Contribution and that It’s a Jungle has the right but not the obligation to perform the acts contained in this Licence (including but not limited to whether the Contribution is published by It’s a Jungle in any form). Any failure by It’s a Jungle to exploit the Contribution shall not be deemed to be waiver of any right under this Licence.

The Contributor’s warranties

7. The Contributor represents and warrants that:

  • all Contributions submitted by Contributor are original works created by Contributor;
  • no Contributions submitted by Contributor infringe or will infringe the intellectual property rights of any third party;
  • Contributor is not bound by any agreement with a third party that would restrict or infringe upon Contributor’s ability to grant the rights granted under this Agreement; and
  • any Contributions submitted by Contributor pursuant to these Terms were a result of substantial human involvement in the creation process, and not using any form of artificial intelligence or other means that lack such substantial human involvement in the output sufficient to give rise to protectible intellectual property rights.

8. Contributor indemnifies and holds It’s a Jungle harmless from and against any loss (including legal costs and expenses on a solicitor/own client basis) or liability incurred or suffered by It’s a Jungle arising from any claim, suit, demand, action or proceeding by any third party alleging that the intellectual property of that party has been infringed by submission of the Contribution, the acts or omissions of the Contributor and/or the use by It’s a Jungle of the intellectual property rights in the Contributions.
